In response to the hearing sent to me in the fine proceedings for a traffic offense (hereinafter referred to as OWI), with the file number according to the subject of this email (222005218903), I would like to comment as follows:

ALLEGATION

First of all, the alleged violation:

I assume that it means that an environmental zone was entered without a sticker. Could you also write it that way, right?

I do not admit to having committed the offense myself.

I enclose a document (PDF printout of an email; attachment I) that seems to me to be suitable to prove that it is factually impossible that I committed an offense at the time in question. Because I was at work and actually doing completely different things that simply could not be done while driving (see timestamp of email).

The contents of the email are otherwise not relevant and are fundamentally of an internal nature, which I would ask you to take into account for compliance reasons if you were to forward this information. I have already blacked out the addresses myself for data protection reasons.

Furthermore, I do not recall anyone else using the vehicle that day. I am therefore unable to provide any further information on this matter.

VEHICLE AND ENVIRONMENTAL ZONE

The vehicle meets all the requirements for driving in an environmental zone. The Tesla Model 3 Performance not only impresses with its beautiful shape. It draws its remarkable power of approx. 535 hp and 660 Nm from four electric motors. These make the car not only a top-quality getaway vehicle (because: the unfortunately badly underpowered police force can no longer keep up with the Lalü-Lala patrol). No, this type of motorization also allows its drivers to legally drive through environmental zones and to display real green stickers.

ENVIRONMENTAL STICKER

I have owned the vehicle for four years and, for the time being, I deny that it does not have an environmental badge visibly attached to it. We will have this checked again, but currently the vehicle is out of my sight in use ((and unfortunately it would run counter to the objectives of this operation if I were to tell you by whom, for what or where))

But be that as it may, as long as you don't hear from me, please assume that everything is really fine here.

GENERAL PROCEDURAL OBSTACLES

Unfortunately, your process is anything but citizen-friendly; the online hearing that you offer simply doesn't work.

When entering a valid ID and password, the following error message appears: “ID expired, ID invalid or password incorrect.” I was able to reproduce the error with various devices.

ACCESSIBILITY

The information on the online hearing is not accessible. It is displayed in a small font on a gray background and is not legible for people with visual impairments.

In addition, you use letters that can be confused, such as a lowercase q that could also be mistaken for a lowercase g.

For this reason alone, I must reject your hearing and request a brief statement as to why this is the case.

Not only as a person heard here, no, also as a person affected, who - also through his work in the Duisburg City Council, which is partly done on an honorary basis - is committed to the concerns of people with disabilities, I request a corresponding follow-up here.

This is really important and has implications that go far, far beyond the OWI under discussion here. I hope you understand that.

CURRENT INVESTIGATION INTO POLICE VIOLENCE

In addition, I note that the officers testifying, the persons, K... (PHK) and Z... (PK) are employees of the South Police Station.

Officers at this station, whose names are not yet known to me, are being investigated as a result of a complaint I filed on December 11, 2024. The details of the allegations are not important here, but unfortunately they are also likely to put stones in the way of the respective officers on their way up to higher pay grades, depending on how the pending proceedings develop. I keep my fingers crossed for everyone concerned, that they get off relatively lightly.

Since, as can be seen from the above, I cannot have committed the crime, it must also be cleared up beyond doubt that this could be an unfounded accusation, in particular because of the short time between the complaint (December 11) and the alleged offense (December 18)

It is more than far-fetched for me to insinuate this. But, as I said, please first rule out the possibility that here - either the persons concerned themselves or other uniformed actors, for example out of a misunderstood sense of collegiality - are operating with incorrect allegations in order to exert undue pressure on a witness.

Otherwise, we'll open a can of worms here that it would be better to leave closed.

I have once again held internal consultations here.

If I see it correctly, the vehicle was being serviced by a service provider on Paul-Esch-Straße from around December 16, 2024 to around December 27, 2024.

Now it is like this: vehicles that are parked on the premises of a car repair shop do not take part in road traffic. There can be no two opinions about that.

So I would see this unsuitable attempt to obtain a fine more as a hook for further training.

And that would be for civil servants on patrol duty, who, with their passion for collecting tickets and their possibly limited legal understanding, may occasionally go a little too far (and are therefore sometimes affectionately referred to as chipmunks because of their tireless industriousness).

On a personal note, I have now corrected a few mistakes that I made in the first e-mail to you today.
